- Compliance with a legal obligation: where we are required to process your data to comply with a regulatory or legal requirement.
- Legitimate interests: where it is necessary for the purposes of our legitimate business interests, provided those interests are not overridden by your rights. Our legitimate interests include providing recruitment services, operating and improving our business, and maintaining relationships with candidates and clients.
- Consent: where we have obtained your explicit consent, for example before sharing your profile with a specific employer, or before processing special category data. You may withdraw consent at any time, without affecting the lawfulness of processing carried out prior to withdrawal.
9. International Data Transfers
Our CRM provider operates in compliance with EU data protection law, and personal data processed through that platform is stored within jurisdictions that provide adequate levels of data protection.
Where any other service provider processes personal data outside Guernsey or the Bailiwick, we take appropriate steps to ensure your information remains protected, including:
- transfers to jurisdictions recognised as providing an adequate level of data protection;
- use of appropriate contractual safeguards; and
- appropriate technical and organisational security measures.
In the unlikely event that a transfer outside Guernsey or the European Economic Area is necessary to a country without an adequate level of protection, we will obtain your explicit consent or ensure appropriate safeguards are in place before making any such transfer.
10. What Happens If You Do Not Provide Your Information
If you do not provide certain information when requested, we may not be able to proceed with your registration or application. For example, we cannot consider you for a role if you are unable to provide evidence of your right to work or the qualifications required for that position.
We will always make clear which information is necessary and which is optional.
11. Data Retention
We retain personal information only for as long as is necessary to fulfil the purposes for which it was collected, including satisfying any legal, regulatory, accounting or reporting requirements.
As a guide:
- candidate records will generally be retained for a period of six years following our last meaningful contact with you, unless you request otherwise;
- we may retain data for longer where required to do so by law or regulation; and

Once your information is no longer required, it will be securely destroyed in accordance with our data retention policy.

We have procedures in place to deal with any suspected data security breach and will notify you and the ODPA where we are legally required to do so.
Please note that no method of transmission over the internet is entirely secure, and while we do everything we can to protect your data, we cannot guarantee absolute security.
